The Terms of Use regulate the relationship between Turf Europe and its Users.
Turf Europe srl is the owner and operator of any Control-Green and Green-GO services, hardware and software in any kind (web app, mobile app, or any other form).
Turf Europe is the designer and manufacturer of Electronic Hardware Device developed with the scope of collecting ambient information for the provision of Services to the Users.
When Users access at Green-GO or Control-Green or use any Turf Europe srl software, hardware or any other service, they accept thoroughly this Terms of Use.
You are responsible for regularly reviewing the most current version of these Terms of Use, which will be available on our website: www.control-football.com and www.greengosystem.com . When we change these Terms of Use, the date of "Last Revision" will be signified.
This is an agreement ("Agreement") between Turf Europe Srl ("Turf Europe"), with registered office in Via Malasoma, 24 - 56121 Pisa, Italy and the User ("User"or "You" or "you" or"your"), a User of Turf Europe "websites, software or services.
"Control-Green" stands for the website www.control-green.com, the web and mobile applications, the software distributed through whatsoever channel and the services provided. "Green-GO" stands for the Electronic Hardware Device and its part on Turf Europe websites and services.
This Agreement is legally binding on both parties and governs both the provision of Turf Europe services and products and their use by the User.
We reserve the right to change all or part of the Term of use at any time. If we do that, we will post the changed terms to the same web page as the old terms. If User continue to use an app after we post changed terms, that use will constitute acceptance of the changed terms.
Software: tools to allow record keeping, activity scheduling, information, alerting, reporting services provided utilizing the data collected through the Software and the Hardware.
Hardware: IoT electronic systems aimed at collecting ambient data and transmitting them to the User through the Software with the sole scope of providing the User focused Services; remote control of hardware systems.
Turf Europe retains the right to have the final discretion in granting to the User the access to the Services.
Turf Europe reserves the right to reject any User without explanation as well as to restrict, limit or revoke the access to Software, Hardware or its Services if a misconduct of the User is detected.
To use and benefit from Turf Europe Services, User must create an account by completing a registration form, by providing us with all required information and activating the "I accept the Terms of Use". User agrees to provide us with complete and accurate information upon registration and to keep such information accurate and up-to-date during use of Turf Europe Services. User is advised to keep login credentials strictly confidential and to refrain from disclosing these to anyone. We shall not be held responsible for unauthorized access to User account arising from User failure to keep User login credentials safe and secure.
Turf Europe reserve the right to access to User account and the information that User have provided but only for support, maintenance and servicing purposes or for any security-related, technical or billing reasons. Also, by sending us a support request, User grant prior consent to access User Account with the sole purpose of answering User request and/or solving any issues User might be facing.
It is User responsibility to protect User personal data and maintain the confidentiality of User information and passwords. User is also responsible for promptly notifying any unauthorized use of User account information or password. To the extent that such loss has not been caused due to gross negligence, willful misconduct, fraud or bad faith by Turf Europe Services, Turf Europe will not be liable for any loss that User may incur as a result of someone else using User Username or password, either with or without User knowledge.
The extent of the Services to which User may have access to may be dependent on the relevant Subscription Plan.
Updates and Functionalities. User acknowledge that from time to time Turf Europe may apply updates to the Software, Hardware or Services and that such updates may result in changes in the appearance and/or functionality of the Software, Hardware or Services (including the addition, modification, or removal of functionality, features, or content).
We offer several different annual Memebership for the Software. Annual Memebership are selectable only after Account registration. All fees quoted on our Control-Green websites are inclusive of VAT or any other taxes that may be applicable in User jurisdiction.
We reserve the right to amend the Memebership and/or Memebership Term at any time or introduce new fees and/or Memebership levels or charges. We will notice you an email in advance during which you will have the right to change your current Memebership.
Your Control-Green membership will continue until terminated. To use Control-Green you must have Internet access and a supported Control-Green device and provide us a Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with third party. Unless you cancel your membership before your billing date or disable auto-renew, you authorize us to charge the membership for the next billing cycle. Control-Green can be purchased in advance only using a credit card. Control-Green provide only yearly Subscription. When the User purchases a yearly plan, his credit card will be charged and automatically billed on a yearly basis. Green-GO reserves the right to change its yearly rates at any time, provided that it will inform the User with notice of the fee change
We may offer several membership plans. Some membership plans may have differing conditions and limitations, which will be disclosed at your membership page. You can find specific details regarding your Control-Green membership by visiting our website and clicking on the "Active plans"" available at the top of the pages of the Conrtol-Green website under your profile name.
Your Control-Green membership may start with a free trial. The duration of the free trial period of your membership will be specified during membership purchasing and is intended to allow new members and certain former members to try the service.
Free trial eligibility is determined by at its sole discretion and we may limit eligibility or duration to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible. We may use information such as device ID, method of payment or an account email address used with an existing or recent Control-Green membership to determine eligibility.
We will charge the membership fee for the next billing cycle to your Payment Method at the end of the free trial period unless you cancel your membership prior to the end of the free trial period.
User can cancel membership with Control-Green at any time and User will continue to have access to the Control-Green service through the end of your billing period. After the end of the paid period all data linked with the Membership will be deleted . A refund for payed Membership is not contemplated. To cancel, go to "Active plans" and delete through the bin icon the selected Membership. You will receive an email with membership cancellation confirmation.
Automatic Renewal is set as default. At the end of paid Membership, for the same yearly Membership. This applies to all Membership involving payment. Automatic Renewal can be disabled.
The initial term of this Agreement is normally for one (1) year. Unless the User takes action within Turf Europe Services to cancel or downgrade service or otherwise notify Turf Europe to the contrary, this Agreement shall automatically extend for additional one period terms, of the same duration of the expired one. The User hereby authorizes Control-Green to charge his credit card for any charges, if applicable, in the additional term.
If the User wishes to terminate this Agreement, he shall follow proper termination procedures.
Control-Green is distributed worldwide, therefore the inventory contains products that are available for sale in many countries. However, we assume no responsibility for the eligibility and registration in your country of products contained in the inventory. Nor do we assume any responsibility if you use a product that is not registered for use on your specific surface. It is up to the Control-Green user to strictly adhere by local regulations in terms of product's use. Control-Green is designed to be a log/plan/optimize tool, not an advisory or sourcing tool.
While we strive to maintain our inventory as accurate as possible, we decline any responsibility for any errors and outdated information in the Control-Green inventory. Therefore the exactitude of product availability, name, brand, form and ingredient dosage are not to be considered binding towards the Control-Green software.
Control-Green declines any responsibility for the standard of quality of the work that is logged/planned within the software. Furthermore, Control-Green cannot be used in law disputes as proof that any of the entries (i.e. work, products distribution, etc.) have effectively been made as specified in the software. Any entry in the Control-Green software is the sole responsibility of the user.
Turf Europe grants the User a limited, non-exclusive license to use the Control-Green Software, excluding any ownership rights. The User agrees on not to impersonate any person or entity, use a fictitious name, or misrepresent his affiliation with a person or entity. The download and installation of any Control-Green Application (web or mobile) takes place under the same limited, non-exclusive license.
The provision of services done by the User to a third party using all or some parts of Control-Green "is forbidden, unless with a written consent of Control-Green.
The User cannot sell or provide, under any form, all or part of the Control-Green service or Application to anybody else, unless with a written consent of Control-Green.
Attempts to reverse engineer or copy, completely or partly, any software, hardware or service of Control-Green, are strictly prohibited without an express written consent of Control-Green.
Using Control-Green Services implies the full responsibility of the User not to infringe any intellectual property or trademark of Control-Green.
The User is expressly prohibited from accessing Control-Green through a virtual private network or by proxy.
All components, contents and details of the design of Software and Hardware, are owned by Turf Europe Srl, and subject to copyright and other intellectual property rights. The User agrees to not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, frame, create derivative works from, transfer, or otherwise use in any other way for commercial or public purposes, in whole or in part, any information, software, hardware products or service obtained, unless after express Turf Europe"s written permission.
When the User sends content through Control-Green, he grants and assigns Control-Green and its affiliates and representatives the possibility to use it for analysis, archiving and creation of other contents, until this is denied in written for by the User.
Control-Green retains the full right to add, modify and delete any content to/from his products and services.
No territorial limitations. Some features and language settings may be not available in some countries.""""""
Turf Europe will never be considered liable for direct or indirect consequences of failure of the services, negligence, or any other tort. Turf Europe is not responsible in any way for damages caused by third parties who use Turf Europe services, including but not limited to people who commit intellectual property infringement, defamation or any other conduct towards the User.
This Agreement shall be governed by the laws in force in Italy. The offer and acceptance of this contract is deemed to have occurred in Italy.
If you use Turf Europe Services, you are subject to our Privacy Policy
The User cannot assign his rights and/or obligations under this Agreement to any other party without a prior written consent from Turf Europe. Turf Europe may assign its rights and/or obligations under this Agreement to any other party at its sole discretion.
